Terms of use

These terms apply to the Trokos website and to any Trokos software obtained from it. Please read them; they are written to be readable.

1. Who may use the software

Trokos tools are intended solely for licensed or registered clinicians (and students under their supervision) who are competent to perform and interpret the relevant assessment independently of the software. By using a tool you confirm that you are such a clinician. The tools are not for patients or members of the public.

2. What the software is, and is not

The software is clinical decision support. It presents information and its sources for a clinician to weigh. It does not diagnose, does not provide medical clearance, does not recommend or prescribe treatment, and does not replace clinical judgement. You remain solely responsible for every clinical decision about your patient. Each tool’s intended-use statement forms part of these terms and prevails over anything on this website.

3. Regulatory status

The Trokos Physical Therapy Reasoning Tool is not currently supplied or made available in the United States. Trokos has made a regulatory-status determination under section 520(o)(1)(E) of the Federal Food, Drug, and Cosmetic Act and is preparing a request for the U.S. Food and Drug Administration’s feedback on it. The software will not be made available in the United States until that process is complete. It is not cleared or approved by FDA. Trokos software is not supplied in Australia through this website.

4. Licence

No Trokos software is currently supplied through this website. If and when a tool is made available, the licence will be non-exclusive and non-transferable, for use in your own clinical practice, and the software and its clinical content may not be resold, sublicensed, redistributed or altered, nor may any notice, intended-use statement or measured-performance disclosure be removed from it.

5. Accuracy and warranty

Measured performance will be published with each tool and inside the software, and updated as the evidence changes. Any software is provided “as is”. To the fullest extent permitted by law Trokos excludes all warranties, express or implied, and its liability to a licensee is limited to the amount paid for the licence in the twelve months before the claim. Nothing in these terms excludes liability that cannot be excluded by law.

6. Updates and withdrawal

Trokos may update its software, its clinical content and these terms. Where a change bears on safety or intended use we will tell licensees. Trokos may withdraw a product at any time; any licence then in force continues for the term paid.

7. Governing law

These terms are governed by the laws of Queensland, Australia, without prejudice to any non-excludable rights you have under the law of your place of residence.
